Welcome to DrivewayStay, operated by Jack O'Brien, ABN 72 317 847 421, trading as DrivewayStay ("DrivewayStay", "we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the DrivewayStay platform, including our website, progressive web application, and related services (collectively, the "Platform").
You accept these Terms by creating an account, by ticking the acceptance box during registration, or by accessing or using the Platform. If you do not agree to these Terms, you must not use the Platform.
DrivewayStay is operated by Jack O'Brien as a sole trader under the trading name "DrivewayStay." All references to "DrivewayStay" in these Terms refer solely to Jack O'Brien operating under that trading name.
DrivewayStay is an online marketplace that connects hosts offering driveway, yard, or outdoor property space with guests seeking short-stay outdoor accommodation. You acknowledge and agree that:
(a) when a guest books a stay, the accommodation agreement is formed directly between the guest and the host. DrivewayStay is not a party to that agreement;
(b) DrivewayStay does not own, operate, manage, inspect, supervise, or control any listed property or any stay;
(c) DrivewayStay is not an accommodation provider, real estate agent, travel agent, insurer, broker, or employer of any user;
(d) DrivewayStay does not guarantee the existence, condition, safety, legality, or suitability of any listing, or the identity, conduct, or reliability of any user; and
(e) when a guest pays for a booking through the Platform, DrivewayStay (through its payment processor, Stripe) collects that payment and remits the host's share to the host. Payment made through the Platform discharges the guest's payment obligation to the host for that booking.
You must be at least 18 years old and capable of forming a binding contract to use the Platform. By registering, you represent and warrant that you meet these requirements. We do not knowingly permit minors to create accounts. If we discover a minor has registered, we will immediately terminate the account and delete associated data.
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use. We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
DrivewayStay requires certain verification steps, including identity verification for guests as described in Section 6, and may require verification steps for hosts. Verification checks are limited in nature, rely on information provided by users and by third-party tools, and cannot identify every risk. Completion of verification is not an endorsement, certification, or guarantee by DrivewayStay of any user's identity, character, or conduct, or of the condition or legality of any property. You must exercise your own care and judgment in all dealings with other users.
As a host, you represent that you have the legal right to offer your driveway, yard, or outdoor property space for short-stay outdoor accommodation. You acknowledge that in New South Wales, the Local Government (Manufactured Home Estates, Caravan Parks, Camping Grounds and Moveable Dwellings) Regulation 2021 generally restricts the installation of caravans, campervans, or tents on private land without council approval to a maximum of two consecutive days and a total of 60 days in any 12-month period. You are solely responsible for ensuring your listing and the frequency of your bookings comply with these limits and all other applicable zoning laws, council regulations, and planning approvals. DrivewayStay does not provide legal, zoning, or planning advice and is not responsible for any enforcement actions or fines resulting from your non-compliance with local laws.
DrivewayStay does not provide insurance coverage for hosts or guests (see Section 8). You are responsible for obtaining any insurance you consider necessary for your property and your participation on the Platform.
You agree to provide accurate listing information, maintain a safe environment, and honour confirmed bookings. You must take reasonable steps to describe your space accurately, disclose known hazards or restrictions in your listing or before check-in, and keep your availability up to date. You must not cancel confirmed bookings except in genuine emergencies — excessive cancellations may result in merit deductions or account suspension.
You acknowledge that DrivewayStay may temporarily suspend or delist your listing using reasonable discretion if your merit score falls below acceptable thresholds, strikes are issued against your account, or your conduct violates these Terms.
You must have an active Stripe Connect account to receive payouts. DrivewayStay is not responsible for delays in payout caused by incomplete Stripe onboarding.
We recommend taking timestamped photos of your space before each guest arrival as evidence in the event of a dispute. DrivewayStay cannot guarantee outcomes in disputes where no photographic evidence is available.
If you opt in to the AI Sketchify feature during listing creation, you grant DrivewayStay a non-exclusive, revocable licence to transform your cover photo into an illustrated artwork style for display on the Platform. You may withdraw this permission at any time by updating your listing settings.
As a guest, you agree to treat host properties with respect, follow all house rules provided by the host, and comply with all applicable laws during your stay. You acknowledge that DrivewayStay facilitates peer-to-peer outdoor accommodation on private residential property, not commercial campgrounds. Your assumption of risk is set out in Section 7.
You must complete identity verification — including government-issued photo ID, rego plate text and photo, and a verification selfie — before making any booking. You must provide accurate vehicle and rego plate information.
You acknowledge that your verification selfie and driver licence images are scheduled for deletion within 48 hours of upload, except where a booking is active or a dispute is open, in which case relevant verification data will be retained until 30 days after checkout or until the dispute is resolved, whichever is later. Only your verified status is retained after deletion.
You must comply with the Leave No Trace policy and must not exceed the agreed number of occupants or the maximum stay duration without the host's explicit consent. You agree to arrive within the agreed check-in window, communicate promptly with your host, and leave the property in the condition you found it.
Outdoor accommodation on private property involves inherent risks. These include, without limitation, uneven or unsealed ground, weather events, fire, water, wildlife and insects, vehicle movement, limited lighting, and facilities that are not commercially operated or maintained.
(a) Guests: You accept each host's property as-is. To the maximum extent permitted by Australian law, you assume all risks associated with your stay, your travel to and from the property, your use of any facilities or add-ons, and any task trade you participate in.
(b) Hosts: To the maximum extent permitted by Australian law, you assume the risks associated with allowing guests, their vehicles, their animals, and their belongings onto your property, including the risk of property damage, and you are solely responsible for deciding which booking requests to accept.
(c) Both guests and hosts acknowledge that DrivewayStay has not inspected any property, is not present during stays, and has no ability to supervise or control the conduct of any user.
Nothing in this Section excludes any right you have under the Australian Consumer Law that cannot be excluded.
DrivewayStay does not provide insurance of any kind to hosts or guests. We strongly recommend that hosts review their home and contents and public liability insurance, and inform their insurer of their hosting activity, and that guests hold appropriate vehicle, contents, travel, and personal insurance. You are solely responsible for assessing whether your insurance arrangements are adequate for your participation on the Platform.
All payments are processed securely through Stripe. By making a booking, you authorise us to charge your payment method for the total amount including applicable platform fees. Payment is authorised and held at the time of booking, and charged in full at the moment the host accepts the booking. If a host declines a booking request, or does not respond within 24 hours, no payment is taken and the authorisation is released in full. If a host cancels after accepting, you receive a full refund of the amount charged.
Platform fees are charged as a percentage of the nightly rate and selected add-ons. Host fees currently start from 7% and guest fees currently start from 7%, with higher rates applicable to certain premium listing tiers including Seasonal Spots, Special Spots, and Long Weekend Spots. Current fee schedules are displayed at checkout and on the Platform. Platform fees are non-refundable except where a host declines or cancels a booking, or where a refund is required by law or determined under Section 15. DrivewayStay is not currently registered for GST. All fees displayed are GST-exclusive. GST obligations will be updated if and when the operator becomes GST-registered. DrivewayStay reserves the right to modify platform fees with reasonable notice provided via email or in-app announcement.
Add-ons selected at booking — including power, water, shower, toilet access, BBQ, fireplace, WiFi, laundry, levelling chocks, and others — are charged at host-set rates subject to platform caps displayed in the app.
The Platform offers optional paid memberships and paid listing tiers. Current pricing and inclusions are displayed in-app before purchase. Paid memberships renew automatically at the end of each billing period until cancelled. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period. Except as required by law, or as provided in Section 26 for material adverse changes, membership fees already paid are not refundable for partial periods. We may change membership and tier pricing or inclusions with reasonable notice in accordance with Section 26.
You may offer or accept Dollary-Doos (task trade) as a voluntary, peer-to-peer gesture of appreciation or partial trade for stays, subject to the host's preference. Task trades are intended to be casual, non-binding, and autonomous arrangements. No task trade creates an employment, contractor, or agency relationship between any user and DrivewayStay, or between users themselves.
To maintain this peer-to-peer status, hosts must not exert employer-like control over guests, including setting rigid hours, providing specific equipment, or directing the precise method of task completion. Guests retain full autonomy over how and when tasks are performed. DrivewayStay is not a party to these trades, does not oversee task quality, and is not liable for any injury, damage, or loss during task completion. Dollary-Doos are host-specific and cannot be transferred or used across different host listings.
Users acknowledge that bartering services may have tax and workers' compensation implications under Australian law and are solely responsible for their own compliance and for assessing and declaring any tax obligations arising from task trades to the Australian Taxation Office.
The following cancellation policy applies to all standard bookings on DrivewayStay:
- Guest cancels more than 30 days before check-in: full refund minus platform fees
- Guest cancels between 14 and 30 days before check-in: 50% refund
- Guest cancels within 14 days of check-in: no refund
For the purpose of calculating cancellation windows, days are counted back from the check-in time stated on the listing (or 2:00 pm local time at the property if none is stated) on the first booked night, in the local time zone of the property. Unless otherwise stated at checkout, add-on charges follow the same refund schedule as the nightly rate. No refund is payable for unused nights where a guest departs early after a stay has commenced, except where required by law or determined under Section 15.
This policy reflects a genuine pre-estimate of loss to the host and platform at each cancellation window. If a host declines a booking request, the guest receives a full refund. If a host cancels a confirmed booking, the guest receives a full refund. Refunds are processed through Stripe and may take 5–10 business days to appear on your statement.
Repeated cancellations by either party may result in merit deductions or account restrictions at DrivewayStay's reasonable discretion. DrivewayStay reserves the right to make refund decisions using reasonable discretion in exceptional circumstances. Nothing in this Section limits your rights under the Australian Consumer Law.
DrivewayStay operates a merit and strike system to maintain community standards. All users are assigned a merit score upon registration. Scores increase through positive behaviour including receiving 5-star reviews, completing verified tasks, and maintaining a clean booking history. Scores decrease through negative behaviour including no-shows, rule breaches, losing disputes, and upheld offence reports.
For the purposes of this section, offences are categorised as follows:
- Minor offence: Minor rule breaches with no damage or safety concern, including leaving a mess, equipment being unavailable, or minor miscommunication
- Moderate offence: Rule breaches involving inconvenience or misrepresentation, including misleading listing information, unresponsive communication, noise complaints, or repeated minor breaches
- Serious offence: Conduct causing damage, safety concern, or significant harm to another user, including aggressive behaviour, entering a guest's space without consent, or filing a false report
- Critical offence: Conduct involving fraud, theft, physical harm, sexual harassment, or any illegal activity
Strike thresholds:
- 3 moderate offences within a 3-month rolling window → 1 strike
- 1 serious offence → 1 strike plus 6-month probation period
- 1 critical offence → immediate 3-month suspension, 50-point merit deduction on return, 2 strikes attached, 12-month probation
- 3rd strike → 1-month suspension plus 12-month probation
- Any new strike or serious or critical offence during probation → permanent ban
DrivewayStay reserves the right to issue demerits, strikes, suspensions, and permanent bans using reasonable discretion based on reported behaviour, evidence reviewed, and community standards. Users subject to suspension or termination may request a review by contacting info@drivewaystay.com.au. Nothing in this section restricts a user's statutory rights under the Australian Consumer Law.
You must not:
(a) circumvent or attempt to circumvent platform fees, including by soliciting, making, or accepting payment for any stay outside the Platform where the connection between guest and host originated on the Platform;
(b) harass, threaten, intimidate, discriminate against, or abuse any other user;
(c) use another user's personal or contact information for any purpose other than the relevant booking or stay;
(d) post content or listings that are false, misleading, unlawful, or that you do not have the right to post;
(e) create multiple accounts, provide false identity or vehicle details, or register or attempt to register a new account while suspended or banned, including by re-using the same identity or vehicle registration details;
(f) interfere with the operation, security, or integrity of the Platform, or access it by automated means except as expressly permitted; or
(g) use the Platform in connection with any unlawful activity.
Breaches of this Section may result in demerits, strikes, suspension, or termination in accordance with Sections 13 and 24, in addition to any other rights we have at law.
Disputes between guests and hosts regarding stays, damage, or conduct are handled through the in-app dispute system. Users must raise disputes within 7 days of the relevant incident. DrivewayStay's admin team will review evidence submitted by both parties and make a decision within 7 days of receiving complete evidence.
DrivewayStay will use reasonable discretion in making dispute decisions. Refunds resulting from upheld disputes are processed manually through Stripe. Users who disagree with a dispute outcome may request a review by contacting info@drivewaystay.com.au.
Nothing in this section restricts a user's statutory rights under the Australian Consumer Law, including the right to seek remedies through their local state or territory consumer tribunal — including but not limited to NCAT (NSW), QCAT (QLD), VCAT (VIC), or equivalent bodies — without first being required to attend mediation in Sydney for low-value matters.
DrivewayStay reserves the right to enable or disable bookings platform-wide at any time including during insurance finalisation, system maintenance, or other operational requirements; enable site-wide maintenance mode during upgrades or changes; modify, suspend, or discontinue any feature, tier, or service at any time with reasonable notice provided via email or in-app announcement; change platform fees, membership pricing, and listing tier costs with notice provided via email or in-app announcement; and remove, hide, or delist any listing that violates these Terms or community standards using reasonable discretion. Continued use of the Platform after any such changes constitutes acceptance of the updated conditions.
We do not guarantee that the Platform will be continuously available, uninterrupted, or error-free.
DrivewayStay is not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, bushfires, floods, power or network outages, government actions, or third-party service failures. In such circumstances, we will use reasonable endeavours to restore service as soon as practicable.
You retain ownership of content you post on the Platform, but you grant us a worldwide, non-exclusive, royalty-free licence to use, display, and distribute that content for the purpose of operating and promoting the Platform. You must not post illegal, offensive, defamatory, or discriminatory content. We reserve the right to remove content and suspend accounts that violate these rules.
The Platform, including its design, features, and community data — including but not limited to Ranger Intel pins, Rainbow Pins, Bush Telegraph amenity data, and Gatherings — is protected by copyright and intellectual property law. You must not scrape, copy, redistribute, or commercially exploit any Platform content or community data without express written permission from DrivewayStay. Screenshot protection is applied to certain map features. Circumventing this protection is a violation of these Terms and may result in immediate account termination.
Your use of the Platform is also governed by our Privacy Policy at drivewaystay.com.au/privacy, which is incorporated into these Terms by reference. Key data handling practices include: automatic removal of GPS and EXIF metadata from all uploaded photos before storage; identity verification selfies and driver licence images scheduled for deletion within 48 hours of upload except where retained for active bookings or open disputes as described in Section 6; and retention of verified status only, without retaining the underlying identity document after the applicable retention period.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted, or modified. Sections 7, 22, and 23 apply only to the maximum extent permitted by law.
To the maximum extent permitted by Australian law:
(a) the Platform is provided on an "as is" and "as available" basis;
(b) DrivewayStay and Jack O'Brien are not liable for the acts or omissions of any host, guest, or other user, for the condition, safety, or legality of any property, or for any loss, damage, injury, or death occurring during, or in connection with, any stay or task trade;
(c) DrivewayStay and Jack O'Brien are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of income, profits, opportunity, data, or goodwill, however arising;
(d) where liability for breach of a guarantee under the Australian Consumer Law can be limited under section 64A of that law, our liability is limited, at our option, to supplying the relevant services again or paying the cost of having them supplied again;
(e) our total aggregate liability for all claims arising out of or in connection with these Terms or the Platform is limited to the total platform fees paid by you to DrivewayStay in the 12 months preceding the event giving rise to the claim. This cap refers to platform fees retained by DrivewayStay and does not include amounts paid to or received from other users, such as nightly rates passed on to hosts; and
(f) nothing in this Section excludes or limits any liability that cannot be excluded or limited under Australian law, including under the Australian Consumer Law.
You agree to indemnify and hold harmless DrivewayStay and Jack O'Brien from and against all claims, damages, losses, liabilities, fines, penalties, costs, and expenses (including reasonable legal fees) arising out of or relating to:
(a) your use of the Platform;
(b) any stay you host or undertake, including claims brought by other users or by third parties such as neighbours, visitors, or council authorities;
(c) your content or listings;
(d) your breach of these Terms or of any applicable law, including local government, zoning, or planning requirements;
(e) any task trade you offer, accept, or perform; and
(f) your tax or other statutory obligations.
This indemnity does not apply to the extent that a claim arises from DrivewayStay's own negligence or breach of law, and nothing in this Section limits your rights under the Australian Consumer Law.
For serious or critical breaches of these Terms — including fraud, theft, physical harm, illegal activity, or immediate safety risks — we may suspend or terminate your account immediately and without prior notice. For all other breaches, we will provide reasonable notice and an opportunity to remedy the breach where practicable. You may delete your account at any time through the in-app settings. Users who believe a termination or suspension was applied incorrectly may request a review by contacting info@drivewaystay.com.au. Certain provisions of these Terms survive termination, including Sections 7, 18, 19, 21, 22, 23, 25, and 27.
These Terms are governed by the laws of New South Wales, Australia. Any dispute arising from these Terms or your use of the Platform will first be attempted to be resolved through good-faith negotiation between the parties. If not resolved within 30 days, disputes may be submitted to mediation in Sydney, New South Wales. If mediation fails, either party may seek relief in the courts of New South Wales or through any relevant state or territory consumer tribunal in the user's jurisdiction, including NCAT (NSW), QCAT (QLD), VCAT (VIC), or equivalent bodies. Users are not required to attend Sydney mediation before accessing their local tribunal for low-value consumer matters.
We may update these Terms at any time, including changes to pricing, platform fees, features, membership tiers, and usage conditions. Where changes are material, we will provide at least 14 days notice via email or in-app announcement. For non-material changes including minor feature adjustments, clarifications, or administrative updates, changes take effect immediately upon posting. Continued use of the Platform after any changes constitutes acceptance of the updated Terms. If a material change negatively impacts your use of the Platform and you do not agree to it, you may terminate your account without penalty and request a pro-rata refund for any prepaid, unused membership or listing tier fees by contacting info@drivewaystay.com.au.
(a) Severability: If any provision of these Terms is found to be void, unenforceable, or unfair under applicable law, that provision is severed or read down to the minimum extent necessary, and the remaining provisions continue in full force.
(b) Entire agreement: These Terms, together with the Privacy Policy and any policies expressly referenced on the Platform, constitute the entire agreement between you and DrivewayStay regarding the Platform. For clarity, they do not form part of, or affect, the separate agreement between a guest and a host for any booking.
(c) No waiver: A failure or delay by either party to enforce any right under these Terms is not a waiver of that right.
(d) Assignment: You may not assign or transfer your rights or obligations under these Terms. DrivewayStay may assign or novate these Terms, with notice to you, to a related entity or to any person or company that acquires or operates the DrivewayStay business, including any company through which Jack O'Brien restructures the business.
(e) No partnership or agency: Except for the limited payment arrangement described in Section 2, nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between DrivewayStay and any user, or between users.
(f) Notices: We may give you notices by email to your registered email address or by in-app announcement, in accordance with these Terms.
(g) Survival: Provisions that by their nature should survive termination of these Terms will survive, including those listed in Section 24.

DrivewayStay only works if hosts and guests can trust each other. These guidelines describe the spirit of how we expect people to treat each other on the platform — the full, legally binding rules live in our Terms of Service, particularly the Prohibited Conduct section.
We expect everyone on DrivewayStay to:
- Treat other users with respect — no harassment, threats, intimidation, discrimination, or abuse
- Be honest — accurate listings, accurate profiles, no false or misleading information
- Honour confirmed bookings — hosts should only cancel in genuine emergencies; guests can cancel according to the cancellation policy
- Only use another user's personal or contact information for the booking or stay it relates to — never for anything else
- Book and pay through the platform — arranging a stay outside DrivewayStay after connecting here undermines the trust and safety systems everyone depends on
- Never create multiple accounts, provide false identity or vehicle details, or register a new account while suspended or banned
How we maintain this:
- DrivewayStay uses a merit score and strike system to track conduct over time. Certain serious breaches — including fraud, theft, physical harm, sexual harassment, or other unlawful conduct — can result in immediate suspension. Other rule breaches affect your merit score and can build into strikes over time, which may lead to suspension or a permanent ban if they continue. If your account is suspended or terminated, you can request a review by contacting info@drivewaystay.com.au. The exact categories, thresholds, and consequences are set out in full in the Terms of Service.
This is a summary. The Terms of Service is the full, binding version of these rules, including exactly what happens if they're broken.
As a host, you're inviting guests onto your own property, so these matter to everyone's safety and trust.
You must:
- Have the legal right to offer your space. In NSW, this includes complying with council rules limiting caravans, campervans, or tents on private land to a maximum of two consecutive days and 60 days total in any 12-month period, and all other applicable zoning, council, and planning requirements in your area (note: this NSW-specific reference is scheduled to be replaced with a general "comply with all applicable local laws" clause once the Terms v2 changes are lawyer-confirmed and shipped — update this page at the same time so the two never say different things)
- Describe your space accurately, and disclose any known hazards or restrictions before check-in
- Keep your availability genuinely up to date
- Maintain a safe environment for guests staying on your property
- Honour confirmed bookings — don't cancel except in genuine emergencies; excessive cancellations can result in merit deductions or account suspension
- Hold your own insurance for your property and hosting activity — DrivewayStay does not provide insurance coverage for hosts
- Have an active Stripe Connect account to receive payouts — DrivewayStay isn't responsible for payout delays caused by incomplete Stripe onboarding
Good practice, not a strict rule, but genuinely worth doing:
- Set out your House Rules clearly on your listing (quiet hours, check-in/out times, minimum stay, and any other requirements) so guests know exactly what to expect
- Respond to booking requests promptly — this is reflected in your host profile over time
- Take timestamped photos of your space before each guest arrival — useful evidence if a dispute ever comes up. DrivewayStay can't guarantee a dispute outcome where no photographic evidence exists

As a guest, you're staying on someone else's property, so these matter just as much as the Host Rules do.
You must:
- Complete identity verification before booking or messaging other users — government-issued photo ID, rego plate text and photo, and a verification selfie
- Provide accurate vehicle and rego plate information
- Respect the host's property and follow all house rules the host provides
- Comply with all applicable laws during your stay
- Comply with the Leave No Trace policy
- Not exceed the agreed number of occupants or the maximum stay duration without the host's explicit consent
- Arrive within the agreed check-in window and communicate promptly with your host
- Honour confirmed bookings, and only cancel according to the cancellation policy
- Book and pay through the platform — never arrange payment outside DrivewayStay for a stay that started here
- Leave the property in the condition you found it
What happens if things go wrong:
- Genuine issues get raised through the in-app dispute system, not worked out privately outside the platform — that way there's a fair, evidence-based process for both sides. Disputes need to be raised within 7 days of the relevant incident.
This is a plain-English summary. Section 6 (Guest Obligations) and Section 14 (Prohibited Conduct) of the Terms of Service are the full, binding version.
Account Credit is a stored-value amount issued by DrivewayStay and recorded against your account in Australian dollars. It may be granted for things like referral rewards or as a discretionary adjustment made by us.
- Account Credit is not legal tender, not a deposit, and not a financial product. It is a promotional stored-value balance issued by DrivewayStay.
- It can only be applied to amounts payable to DrivewayStay, such as subscription charges and platform fees. It cannot be applied to amounts payable directly to a host.
- It is not redeemable for cash, cannot be withdrawn, and has no cash-out value in any circumstance, including on account closure.
- It is non-transferable. It cannot be gifted, sold, assigned, or moved between accounts.
- We may reduce, withhold, suspend, or cancel Account Credit where we reasonably suspect fraud, abuse, referral manipulation, or a breach of these Terms, and where it was issued in error.
- Account Credit does not expire unless we say otherwise at the time it is issued or as required by law.
Account Credit is entirely separate from Dollary-Doos. Dollary-Doos are a voluntary host-specific barter arrangement earned through tasks and spent only with that same host. Account Credit is platform-issued and dollar-denominated. The two balances are held separately, are governed by different rules, and can never be combined, converted, or exchanged for one another.
